WASHINGTON -- Within the U.S. Senate's comprehensive immigration bill is a proposal to create a database that may shed new light on H-1B hiring.

The intent of the database is to help improve the odds that a U.S. worker may get hired over a foreign worker. But the bill's effectiveness may rise and fall on fuzzy concepts, such as "preference" and "good faith" hiring efforts, and its enforcement provisions. This is where the legislative battle may be fought.

There are a string of provisions in the Senate's bill its proponents say are intended to help U.S. workers. One is a requirement for the government to create a national database of jobs that employers want to fill with H-1B workers. U.S. workers will be able to apply for those jobs, which will be posted for 30 days. Employers are also barred "from recruiting or giving preference" to visa workers over U.S. workers.

The tech industry is concerned that the immigration bill's recruitment and database provisions may extend the amount of time needed to hire an H-1B worker and, more broadly, increase the risk of litigation and government oversight.

The final shape of the Senate's comprehensive immigration bill is now being set. The Senate Judiciary Committee is due to meet Thursday to begin considering a series of amendments to the bill. This is expected to take several days.

H-1B critics are already skeptical about the bill, which raises the base H-1B cap from 65,000 to as high as 180,000, based on a market adjustment provision.

There "is no enforcement mechanism," in the bill, said John Miano, who founded the Programmers Guild, an organization that has long had concerns about the H-1B program. He can point to history to back up his view.

Under present law, H-1B dependent employers are required to make a "good faith" effort to hire U.S. workers. According to the U.S. Department of Labor, a good faith hiring effort is one where U.S. workers "must be given fair consideration for jobs."

Meanwhile, USA Today reveals how traitorous senator Orrin Hatch plans to throw American techies under the bus:

Measure would ease hiring rules for U.S. tech firms

WASHINGTON — Most U.S. technology companies would not have to first offer jobs to Americans before hiring overseas workers, under a measure introduced late Tuesday by Sen. Orrin Hatch, R-Utah.

The provision is one of a several industry-friendly amendments proposed by Hatch ahead of the Senate Judiciary Committee's markup of the chamber's leading immigration bill. The bill's current language requires companies to first extend job offers to equally qualified U.S. workers for highly skilled jobs in programming, engineering and other fields before hiring foreign workers on temporary H-1B visas.

It also would give the U.S. Department of Labor the power to review and challenge individual hiring decisions for up to two years after they are made. Technology firms have lobbied aggressively to change the language, saying it amounts to government overreach.

The proposal by Hatch would impose those requirements only on companies that rely on H-1B holders for 15% or more of their workforce — a move that largely targets consulting companies that supply workers temporarily to the USA. Many of those companies are based in India.

$45 million ATM heist: Hacked bank uses Infosys solution

MUMBAI: National Bank of Ras Al Khaimah PSC (Rakbank) of the United Arab Emirates, which was one of the two banks that were defrauded in the $45 million (Rs 247 crore) global ATM heist, uses Infosys' Finacle banking software.

US federal prosecutors said in a complaint last week that Rakbank and Bank of Muscat Oman were hacked by a global cybercrime ring, which first breached the computers at an outsourced Indian credit card processor in December and then the computers of a similar American processor to gain access to critical data that made the crime possible.

It could not be verified if Infosys does credit card processing for the bank or if the Bangalore-based outsourcer merely sold its banking software. Infosys declined to comment for this story. The prosecutors did not name the Indian companies whose systems were breached. ET could not immediately establish who the bank's other service providers were.

The Middle-East bank finished implementing the Finacle core banking solution in January this year, and 7,00,000 customers had migrated to the new solution since Juny 2012, the company said in a statement in January. "The core banking solution supports more than 325,000 accounts and facilitates an average of 2,50,000 transactions daily across Rakbank's various branches," the bank had said in a January 7 statement.

The heist, which was predicated on the breach of an Indian outsourcing company, comes at a time when the sector is facing immense scrutiny about its cybersecurity.

India has threatened to stall a Free Trade Agreement with Europe, unless given a Data Secure Status, which would help the country attract more work from that continent. The European Union has been unwilling to give India the status given the lack of enforcement, accountability and penalty guidelines in the country's existing Information Technology rules.

Forced advertisement in a national database is definitely better than newspapers, but it will still be inefective, as we all know there is no bottom to the tricks the indian griftologists use. They will simply advertise obscure skills that nobody has, then the guy they bring from india will have these skills of course, because his CV is fake anyway.

Comprehensive Immigration Reform is not good for America.The bill has "some" provisions to tighten Guest Worker visa programs.But as we know no matter how strict it is , it will be exploited be fraud Indians.They know how to game the system. Only way out is completely eliminate these corporate welfare programs.

Even worse following provisions in CIR regarding Green Cards (I think it is going to be debated coming week) are more suicidal for American workers.
1. Eliminate per country limit: Current system supports diversity and each country will get only 7% of total employment GC. All countries except India has relatively acceptable processing times. India is backlogged due to the volume of applications from this country. Now they want to remove this cap so that they can flood the system.Earlier a separate bill HR3012 was introduced and failed in House.

2. Exclude EB1C GC category and STEM category from GC  quota: No need of explanation this is like giving unlimited GC to Indians. All Indian companies nowadays file GC in EB1C due to loose eligibility requirement.They are trying to use this as a replacement for H1B. Now in CIR they are excluding this from  total GC cap of 140k?? wow it is suicidal. Same go with STEM workers. Every Indian is going to get admission in some crappy colleges in USA and will be excluded in the name of a STEM worker.After CIR you will only see INDIANS in IT. So no hope for other ethnic group. Please write your senators to stop this F***king amendments!!!
