The United States Attorney's Office for the Middle District of Pennsylvania, announced the sentencing of a defendant convicted of visa fraud and money laundering in connection with the procurement of H-1b Visas and Green Cards for ineligible or unqualified Indian nationals
(as if there is any other kind).

According to United States Attorney Peter J. Smith, Dynanoba "Ken" Kendre, 43, of Mechanicsburg, was sentenced yesterday to 21 months' imprisonment and ordered to pay $100,112 in restitution following his guilty plea to visa fraud and money laundering charges. The sentence was imposed by Senior United States District Judge Sylvia H. Rambo in Harrisburg, Smith said.

The charges to which Kendre pleaded guilty stemmed from an investigation conducted by the U.S. Department of Labor, Office of Inspector General; the Internal Revenue Service, Criminal Investigation; the Department of Homeland Security, Homeland Security Investigations; and U.S. Citizenship and Immigration Services, Fraud Detection and National Security.

The investigation revealed that Kendre, owner of Global Empire, d/b/a Global Healthcare Group and Fortune 500 Systems, defrauded the H1-b, Temporary Foreign Worker Visa Program, as well as the Permanent Labor Certification Program, by submitting Labor Condition Applications containing false and misleading information. Kendre accepted cash payments from foreign workers, who were not employed, in order to produce false payroll checks and W-2 wage and tax statements indicating the foreign worker was so employed. The fake payroll checks and W-2 wage and tax statements were submitted in support of H1-b Visa renewals or for adjustments of alien status by way of the Permanent Labor Certification Program. Foreign workers also paid Kendre a $5,000.00 "Annual Maintenance Fee" for keeping a Visa active with the company as well as a 25% fee for each payroll check processed by the company.

H-1b Visas are issued by the Department of Homeland Security, U.S. Citizenship and Immigration Services (USCIS), and permit qualified alien workers entry into the United States to work in a specialty occupation. A specialty occupation, such as health care, requires alien workers to meet certain educational and professional requirements established by USCIS and an employer's petition on their behalf. The number of petitions filed with USCIS each year far exceeds the limited number of H-1B Visas available, so they are valuable to alien workers and a source of illicit profit to corrupt employers. Securing an H-1B Visa often represents the first step in obtaining permanent lawful residency via a Green Card and, ultimately, U.S. citizenship.

Despite Kendre's representations in petitions to federal agencies, few of the individuals for whom he submitted petitions actually performed work for his company. When there was no work at his company for them, Kendre instructed the foreign workers to secure cash-paying jobs in other locations. Kendre then engaged in a process known as "running the payroll," whereby the visa recipients were instructed to pay Kendre an amount based on the prevailing wage for which they were petitioned, plus a 25% fee that was to cover the company's payroll taxes. Kendre then had his company issue payroll checks for the foreign workers. Those payments were used in part to pay the visa recipients back, as falsified proof of compliance with the terms of their visa requirements and in order to apply for Green Cards. Other portions of the payments were used to pay the company's payroll taxes owed the government, to perpetuate the false visa petitions, and pocketed as profit by Kendre.

In addition to the jail term and restitution, Kendre also was ordered to serve 3 years of supervised release following his prison term.

U.S. Attorney Smith thanked the federal agencies involved in the case for their steadfast assistance. Smith said, "The defendant's criminal activity in this case spanned a number of years and involved the work of multiple federal agencies. The just result in this successful prosecution was achieved through the diligent work of our federal law enforcement partners. I thank them for their consistent excellent efforts."

Eric Hylton, Special Agent in Charge of IRS, Criminal Investigation stated, "Today's sentencing is a direct result of the excellent partnership the IRS, along with other Federal Law Enforcement Agencies, and the U.S. Attorney's Office has in combating violations of Federal Law. This sentence should serve as a deterrent to those who might contemplate similar fraudulent actions."

That sentiment was echoed by John Sprately, Special Agent-in-Charge for the Philadelphia Region of the U.S. Department of Labor, Office of Inspector General. Spratley stated, "Today's sentencing underscores our efforts to investigate fraud against the Department of Labor's foreign labor certification programs. The defendant falsified labor certification applications, for considerable financial gain, in order to illegally obtain visa renewals and permanent residence cards for foreign nationals. The Office of Inspector General and its law enforcement partners remain committed to combating this and any other fraud perpetrated against Department of Labor programs."

The case was prosecuted by Assistant United States Attorney James T. Clancy.

Techie held for trying to extort 5cr from trader



NEW DELHI: A computer professional was arrested on Friday for allegedly making extortion calls to a south Delhi businessman. The accused, Anil Sharma, was the businessman's former employee and chose him as his target as he had enough details about the family, said police.

The businessman received an extortion call on September 11 from a person who claimed to be working for Dawood Ibrahim. Police said the caller asked for a ransom of Rs 5crore and threatened to kidnap and murder the victim's son (24) if his demands were not met. The businessman immediately reported the matter to police.

Cops had a hard time tracing Sharma, an MCA, as he communicated with the businessman mainly through messages and did not make many calls. However, using technical surveillance, Sharma was finally nabbed.

"After registering a case of extortion, the matter was being investigated. The phones of the businessman and the number of the caller were put under surveillance. We were finally able to trace the call on Friday and arrested the accused from the Safdarjung area. He turned out to be a computer expert instead of Dawood's agent," said a police source.

Cops said during interrogation the accused admitted he had procured the SIM card using fake documents about eight months back.

Speaking to TOI, the businessman said, "I will never forget the trauma we went through after I received the extortion calls. We were so terrified that no one from our family stepped out of the house in the past 12 days."

In the case you mentioned I wonder how could Indian Police fall for this unimaginative trap ? Why would Dawood Ibrahim want money from some Indian ?

That way Dawood Ibrahim has always been a good citizen of this world. Doing good  useful retail business. Everytime I use a tissue towel to clean I feel so immensely thankful to Sree Dawood Ibrahim .

Even today in India you might somehow purchase a tissue box from one of those malls owned by Ambani or Tumbani. But by the time you reach home , your wallet , tissue box etc would have got pilfered.

A:  If the federal government dumped 64k pages of IRS tax code and leveled the playing field; balanced it's budget (meaning expenditures=income, no funny math); forced mark-to-market accounting; defined an orderly method to clear the economy of around half the outstanding bad debt at the same time they restored faith in the markets (throw banksters/wall street con artists in jail), you'd see the economy recover without the need to deport a bunch of foreigners.  Fact is blaming them for our economic woes is fool hearty at best guys.

B:  Should we deport em?  Yes.  Would Mr. Jose' defend America if China decided to invade?  The reason they are here is for a "better life"; they do not believe in anything we believe in and their illegal, immoral back-@sswards activities are proof of this.  Doesn't matter where they come from.  No, stealing, rape, plunder, killing, these things are not "diversity"; they are things that need to be dealt with by the barrel of a gun and there isn't a single red-blooded American who doesn't think otherwise.

Thank you immensely with all my heart James & thus busting more plaque from my my brain.

I thought MCA meant equivalent of say Bill Gates.Don't blame me for thinking like that. My sister in law Dr.Saroja's  ( a toxic quack a toxic harvester of many uteruses, ovaries & fallopian tubes )daughter called Uma is one such MCA married to one Rajesh calling himself another MCA. They self label themselves  "computer wizards".

Uma got work in Wipro & even Infosys later I can't remember. She got free air travel in business class , free accommodation in five star hotels in Bangalore. Thus started throwing her weight around. Started wearing branded adrk glasses , trousers , tight T-shirts with provocative messages , sat cross legged without removing her sandals & shoes.

I have seen her during my " bride seeing " ceremony & several times. She was then a paavadai ( full skirt clad) wearing , double plaited typical Tambram with a "even butter would not melt in my mouth " demeanour.

When I was staying in Karpagam lodge in Mylapore Chennai Uma came barging in with her parents & many parasites , ordering me to give her FREE DINNER. When we went down , she sat cross legged , wolfed down  family sized masala dosas , vadais , mysore paks etc. That did not surprise me as that is how Indians behave. This is their characteristically POLITE & FRIENDLY behaviour.  For dessert she snapped her fingers calling the waiter & gesticulated with her left hand ( mark of ultra confidence that MCA confers instantly in India) & said:-

" Bring me a tub of Pista icecream floating in a pool of Thumbs Up ".

I had never imagined or heard of such a dessert.

And slurped the whole lot.

I paid for everything. At last the penny drops.

I sent the following letter to my senators and congressmen, please do the same, for the sake of saving the IT field in this country!!!

The per country limit ensures that no one country monopolizes the employment based immigration system. If we remove this cap, certain countries that are known to have abused the employment based immigration system via body shops, sweat shops and employee exploitation, will prevent the genuine talented individuals from other countries to immigrate. There is no cap on student visas and please look at the recent news of how one country is abusing the student visa program in California, Virginia and other places.

The argument, often used in favor of this bill, is that Indian nationals are waiting while other small countries cannot reach their cap of 7%. But the fact is, when other countries are not reaching their cap, the remaining visas go to india. You can review the number of visas Indian nationals received in each of the last several years and you will see India is receiving 30% - 40% of the available visas, which is a lot more than the cap of 7%.

Another argument used in favor of this bill is that American businesses will be able to hire more high skilled immigrants. That is a fallacy, since this bill doesn't increase the total number of employment based visas available each year. So, not only that American companies will not be able to hire any more skilled immigrants than they are hiring now, but they will be strictly limited of hiring Indian and Chinese nationals for years to come.

The limitation per country was created for a reason and eliminating it would mean the green cards will go only for citizens of China and India - no other country would be able to compete with the overwhelming inflow of green card applicants from those countries - India in particular. The process would not create diversity in the immigrant labor force and will be dominated by Indian citizens.

I strongly oppose this bill since this bill is very parochial in its scope and was introduced by lobbyists to benefit one specific country.
